Racial Discrimination Strikes Housing Market

It was a dream according to George and Peytyn Willborn, not deferred but denied. They had found their dream house! Despite agreeing on a $1.7 million purchase price, owners Daniel and Adrienne Sabbia never signed a purchase contract with the Willborns, according to a complaint that is now part of a federal housing discrimination action. The U.S Department of Housing and Urban Development announced August 10 that it has charged the Sabbias, their real estate agent and a real estate broker with refusing to sell their home to a black couple, a violation of the Fair Housing Act.

The complaint alleged that the Sabbias and Prudential real estate agent Jeffrey Lowe stalled negotiations and took the property off the market in January after receiving a $1.7 million offer from radio personality and comedian George Willborn and his wife, businesswoman Peytyn Willborn.

According to published reports, the house was back on the market by March and listed again for an asking price of $1.799 million.

According to the complaint, the Willborns’ offer was the highest the sellers had received in the two years the property had been on the market. However, when faced with signing the sales contract, the Sabbias refused.

Dylcia Cornelious, the Willborns’ agent, said while the Willborns have found another home and the closing is pending, the pain remains. “They are absolutely still reeling from this,” she said. “It’s hurtful, unacceptable in this day and age. You can’t choose who you can sell your home to.”

Cornelious said the Willborns loved the house. “It was perfect. The children had picked out their rooms.”

The complaint stated that real estate agent Lowe told Cornelious on Jan. 11 that the Sabbias had changed their minds and were taking the home off the market, despite it having been listed for sale for almost two years. Lowe gave various reasons as to why he said the Sabbias had decided not to sell, which included Adrienne Sabbia having changed her mind when the couple couldn’t find a suitable new home to move to, and wanting to keep the children in their current schools.

‘Unlawful Discrimination

“By refusing to sign the sales contract,” HUD said in its complaint, the Sabbias “committed unlawful discrimination” by refusing to sell the home to the Willborns “after the making of a bona fide offer because of their race, African-American.”

According to the complaint, during the negotiations, Lowe told Cornelious that his sellers had researched the Willborns. The complaint noted that Internet searches of George Willborn produced numerous images of him.

The Willborns filed a complaint with HUD Jan. 28, and after receiving the complaint, HUD said the Sabbias on Feb. 1 offered to sell their home and all its furniture to the Willborns for $1.799 million. The Willborns declined.

“I was appalled,” Willborn told the Chicago Tribune. “The feeling that my entire family has, it’s hard to describe. You’re talking about 2010. I don’t know if people realize it, but we elected an African-American president, so it’s not asking too much to be able to live where we want to live.”

Willborn said the couple found it difficult to explain to their children what had happened. So they bought a copy of the television miniseries “Roots” and watched it as a family. They then talked to their son and daughter about prejudice.

“I’ve had to talk to my kids about sex and drugs and all the things they need to arm them,” he said. “We talk about race, of course, like every family, but I never had to do what I had to do in this case,” he told the Chicago Tribune. According to the complaint, Lowe said in a HUD interview while under oath that while he was representing the Sabbias, Daniel Sabbia told him, “he would prefer not to sell the home to an African-American, though he qualified the testimony, saying ‘but if it was for the right price he did not care who bought the house.’”

The Sabbias, Lowe and Prudential will decide whether they want the case heard by an administrative law judge or a federal district judge in Chicago.

If discrimination is found, the Sabbias, their agent and his firm could be forced to pay civil penalties to HUD and financial damages to the Willborns and Cornelious.

The HUD Assistant Secretary for Fair Housing and Equal Opportunity, John Trasvina, stated in a prepared press release, “Racial fairness is important at all income levels. Civil rights and for Schmidt must be the effective shield against housing discrimination that in this case wealth was not.”

My Take: It is difficult to believe that this type of blatant racism is still active in this country. However, I am a realist and I know it is still there. I grew up in a family where the “N” was used all the time. But, in my family it was not used against just African-Americans. It was used against anybody who was an idiot and did stupid stunts. It took me a long time to stop using the word because of this. I consider it a cuss word that can be used on any person, no matter what the color of their skin.

Maybe this couple should have looked at Nyack NY real estate instead or even maybe Palisades real estate. They probably still would’ve been able to find their dream home without all the hassles. Maybe they should have even built their own house. Of course, they would probably need Denver CO construction attorneys make sure that everything was done correctly. And if anything was done incorrectly they would need Denver CO construction deficit attorneys. But instead they are now looking to hire a discrimination attorney.

On August 5, Freddie Mac released a survey that indicates mortgage rates fell last week of July adding to the series of record lows adding to concerns about the state of the economy. With the recent expiration of popular homebuyer tax credits, the rock-bottom rates offer a glimmer of hope for the housing market that is struggling to gain its footing once again.

Interest rates on 30-year fixed-rate mortgages, the most widely used loan, averaged 4.49% for the week to August 5, down from 4.54% a week earlier and my .22% a year ago, according to the survey.

Thirty-year rates have fallen to fresh lows in six out of the last seven weeks. Freddie Mac, the second-largest U.S. mortgage finance company, started the survey in April 1971.

Fifteen-year fixed-rate mortgages averaged 3.95%, down from 4.0% last week, the lowest since Freddie Mac began surveying this loan type in 1991. Fifteen-year rates have hit fresh lows in five of the last seven weeks.

With rates near their lowest since Freddie Mac started the survey, demand for loans to refinance or purchase homes has picked up, boding well for the market and the economy.

“Yet again, interest rates for fixed-rate mortgages and now the hybrid 5-year ARM (adjustable-rate mortgage) fell to … record lows this week following the second-quarter GDP release,” Frank Nothaft, Freddie Mac vice president and chief economist, said in a statement.

Annual revisions cut cumulative growth in U.S. gross domestic product over the past three years to 0.6% from 1.4%, reducing inflationary pressures and allowing longer-term rates room to ease, he said.

Cameron Findlay, chief economist at LendingTree.com in Charlotte, North Carolina, said the housing market is vulnerable, with a flood of foreclosures in the pipeline and high unemployment weighing heavily.

“The world essentially collapsed after the tax credits expired,” he said. “This baby cannot walk on its own without government intervention.”

Findlay said his biggest concern is that the economy is going to stall and believes there is a 30% chance of a double-dip recession.

“Low mortgage rates are certainly a positive, but jobs growth is more important and without that, a housing rebound will not emerge,” he said.

The U.S. Labor Department said on August 5 new claims for unemployment benefits rose last week to the highest since early April. On Friday it will release July U.S. payrolls data.

The Mortgage Bankers Association said on Wednesday U.S. mortgage applications to purchase homes rose last week for a third straight week as rates tumbled.

Freddie Mac said the rate on the 5/1 ARM, set at a fixed rate for five years and adjustable each following year, was 3.63%, down from 3.76% last week, its lowest level since Freddie Mac began tracking this loan type in 2005.

For a year ARMs were at 3.55% are now down 3.64% as of last week. Only a year ago, 15 year mortgages averaged about 4.63% and the ARM was at 4.78% with the 5/1 ARM at 4.73%

My Take: This is very encouraging! I am trying to buy a house so I am very happy about these figures. Of course, if I had the money I’d probably buy a one of the villas in Marbella because it’s beautiful in Spain. However, I cannot afford the Marbella homes. I’m looking to buy a home in Phoenix Arizona where I live. I need to write mortgage broker can be difficult though.

I have looked at Louisville Kentucky mortgage services as well as Phoenix Arizona mortgage services. A Louisville mortgage is a little bit more expensive some of the Phoenix mortgages. I plan on comparing his many mortgage brokers as possible to get the right mortgage.

There is one thing I know I will not need and that is landscaping. Landscaping Phoenix only heats up the house. Now New Jersey landscaping would be great if I lived in New Jersey because their summers are not like Phoenix. In fact, I have seen some pictures of NJ residential landscaping and it is beautiful.

Is it a sign that the cost to taxpayers for bailing out the mortgage giant, Fannie Mae, could be less than once thought? Fannie Mae is actually asking for less money this quarter. On August 5, the government controlled mortgage buyer said they were able to set aside enough money to cover the majority of losses from bad loans made 2005-2008.

It requested $1.5 billion in additional taxpayer aid after posting the best quarterly results since the company was put under federal control in September 2008. It was also the smallest quarterly request for assistance since November 2008.

Analysts, however, cautioned that the company’s financial picture could still weaken. Anthony Sanders, a finance professor at George Mason University, said the numbers are artificially low because of the slow pace of the foreclosure process.

“These foreclosures are gathering up,” Sanders said. “The dam is going to break eventually.”

Fannie Mae said August 5 that it lost $3.13 billion, or 55 cents per share, in the April-to-June period. The company’s losses take into account $1.9 billion in dividends paid to the Treasury Department. They compare with a loss of $15.2 billion, or $2.67 a share, in the quarter a year ago.

“Across our industry, we are seeing a more realistic approach to housing and lending that bodes well for the future,” Mike Williams, the company’s chief executive, said in a statement. The company said loans made last year are faring slightly better than those made during 2001 through 2004, before the company lowered its lending standards.

The government rescued Fannie Mae and sibling company Freddie Mac from the brink of failure nearly two years ago. The new request means they have needed $146.4 billion to stay afloat.

Fannie and Freddie own or guarantee about half of all U.S. mortgages, or nearly 31 million home loans worth more than $5 trillion. They buy home loans from lenders, package them into bonds with a guarantee against default and sell them to investors.

Fannie Mae had $218.2 billion in bad loans at the end of June, up only slightly from $216.5 billion at the end of last year. It owned more than 129,000 foreclosed properties, up from nearly 110,000 at the end of April.

Some analysts doubt that company has turned a corner. Once mortgage modifications made under the federal government’s $75 billion homeowner assistance start to go bad, they say, Fannie Mae will start to be hit with increased losses.

“They’re putting a rosy picture on it,” said Edward Pinto, a housing consultant who served as Fannie’s chief credit officer in the late 1980s. “Basically, they’re kicking the can down the road on these modifications.”

Edward DeMarco, the government’s chief regulator of the two companies, said in interview last week that the total cost to taxpayers for rescuing Fannie and Freddie should be less than $400 billion. That’s under most economic scenarios, he said.

Over the next year, lawmakers plan to review the entire system for providing mortgages to Americans. That could include a dramatic overhaul of Fannie and Freddie, or ultimately their elimination.

The financial overhaul signed by President Barack Obama didn’t address that issue, despite protests from Republicans that it was incomplete without such a plan. The administration is holding a public conference on Aug. 17 in Washington to discuss the mortgage system.

“The country needs lawmakers to come to an agreement on this,” DeMarco said. The mortgage market, he said, can’t operate indefinitely with the government providing life support. “We’re going to have to figure out a solution.”

According to Jim Vogel, an analyst at FTN financial, if Fannie Mae’s losses keep falling it could make finding a solution easier for lawmakers. “This is the 1st step toward really opening the dialogue about what comes next,” he stated. “You can’t talk about the future when you still have losses hanging over your head.”

My Take: It would be a miracle if this actually occurred! I am sorry, any business that needs help in the form of a small business loan or tax cuts during a recession is not going to get out of trouble quickly. Tappan Zee Bridge Replacement Plans Underway | Piermont Real Estate

Many of the owners of the gorgeous and historic Rockland County waterfront homes are now anxiously awaiting final approval of long-sought plans to replace the historic Tappan Zee Bridge, which is now 52 years old and showing its age.

It had been thought that, following the devastating collapse of Mississippi Bridge in 2007 that killed seven people that those who own choice Piermont real estate and other Rockland County taxpayers would hear about repairs for the old Tappan.  But county officials have other plans.

It was decided in late 2008 that roughly 80 percent of the three-mile bridge, which spans across the Hudson River and serves as a major commuter route to and from New York City, is outdated and would have to be replaced, not repaired, in order to bring it up to standards.

The price tag, however, is significant: $6.4 billion.  Officials want the new bridge new bridge to accommodate four lanes of traffic in each direction, and be able to handle high-speed bus service between Port Chester, in Westchester County, and Suffern, in Rockland County.   Plans for the replacement of the bridge are expected to be finalized by spring of 2010, with construction to commence by 2012, according to Tappan Zee Bridge project manager, Michael Anderson.
