Google Sued over Android

An Oracle spokeswoman, Karen Tillman, said in a statement on August 12 that it is suing Google Inc. for alleged patent and copyright infringement in the development of the popular Android Smartphone software. Oracle claims that Google “knowingly, directly and repeatedly infringed on Oracle’s Java related intellectual property” when developing Android. She further stated, “This lawsuit seeks appropriate remedies jury”

Oracle acquired Java through its $5.6 billion purchase of Sun Microsystems earlier this year. Analysts said the suit against Google could signal that Oracle intends to be more aggressive in seeking licensees for Java, a technology that is used in many types of Internet-based products.

Oracle Chief Executive Larry Ellison has said he views the Java software as a key asset, pointing to its use in a variety of electronic devices, from PCs to DVD players.

Oracle, which makes database software and other technology, acquired the Java computer programming language and related technology when it bought Sun Microsystems. A deal that closed in January.

“Sun’s corporate philosophy was obviously very different from Oracle’s in terms of enforcing the Java patents,” said Edward Reines, an IP litigator at Weil Gotshall who is involved in separate patent litigation against Oracle.

A Google spokesman said he could not comment on the lawsuit as the company had not had a chance to review it yet.

Analysts say Google’s Android operating system uses portions of Java technology.

About 200,000 smartphones and other devices based on the Android operating system are sold each day, Google Chief Executive Eric Schmidt said at an August 4 conference.

Java can be used as a platform for building applications for computers, websites and smart phones and other mobile devices.

In its complaint, filed with the U.S. District Court for the Northern District of California, Oracle said Google’s Android operating system software consists of Java applications and other technology. As such, it infringes on one or more parts of seven different patents – something Google should know, Oracle argues, because it has hired former Sun Java engineers in recent years.

Oracle also said Google’s Android also infringes on Oracle’s copyrights in Java.

Google says about 200,000 Android-powered phones are being sold each day.

Oracle is seeking an injunction to stop Google from further building and distributing Android, plus higher monetary damages for willful and deliberate infringement.

The case is Oracle of America Inc v Google Inc, in U.S. District Court for the Northern District of California.

My Take: Well, it looks like Google did a big boo-boo, at least on the surface anyway. Maybe they should’ve gotten some software consulting before they did anything. I know that they were smart enough to do a software test before doing anything else, why didn’t they do some consulting as well? Or at least they should check on the legalities of using that software.

I doubt that Google will disappear because of this. If they did a lot of SEO services would have problems because they rely on Google analytics to get their clients on page 1. Of course, they do use the other search engines that are available on the Internet as well. Even the best SEO services knows that Google is not the only search engine to work with, but it is one of the better search engines.

Net Neutrality Rules Proposed

Today Google and Verizon announced their proposal for an “open Internet,” in which they campaign for strict enforcement of a transparent and open wireline broadband service, but with loopholes for wireless service and “differentiated” wireline services like home health care monitoring.

The proposal — which is likely to carry weight as it comes from powerhouses of both content and broadband services — is an answer to the so-called “net neutrality” debate. Proponents for net neutrality demand that any Internet content or service be delivered by any broadband or wireless provider. The fear is that consumers would be charged extra for some content, like cable TV programming, or blocked from certain activities in order for the broadband provider to gain some competitive advantage.

Here, Google and Verizon are arguing that, for the most part, wireline services like cable, fiber-optic or DSL broadband should be required to maintain a network that gives consumers “access to all legal content on the Internet, and can use what applications, services and devices they choose.”

This would ensure that broadband providers wouldn’t curb access to competitors, according to the proposal. Not only that, they couldn’t even charge extra to deliver some services over others.

The proposal argues for transparency. Consumers must be “fully informed about their Internet experiences.” If there was some kind of interruption in services, the broadband provider would be required to explain it. The FCC would have the power to enforce these rules — using a “complaint-driven process” of evaluation — and to penalize “bad actors” with fines up to $2 million.

Though the plan includes much of what net neutrality advocates have pleaded for, there are two glaring omissions to the proposed rules:

1. “We would not now apply most of the wireline principles to wireless,” says the proposal, “except for the transparency requirement.” Meaning that wireless carriers — including Verizon’s No. 1 ranked mobile subsidiary — would be at liberty to provide preferential access to certain services, block others, and charge customers extra if they saw fit.

2. “Our proposal would allow broadband providers to offer additional, differentiated online services” that they could in fact charge extra for, and offer with limited access or with the requirement of specified equipment. The examples provided are vast: “Health care monitoring, the smart grid, advanced educational services, or new entertainment and gaming options.”

Google and Verizon are clear about the possible misuse of such a loophole. The proposal cites “safeguards to ensure that such online services must be distinguishable from traditional broadband Internet access services and are not designed to circumvent the rules.”

Of course, the two companies aren’t making any laws here, just proposing guidelines. They close with a plea for other “stakeholders” to propose “constructive ideas for an open Internet policy that puts consumers in charge and enhances America’s leadership in the broadband world,” saying they will work with “Congress, the FCC and all interested parties” moving forward.

Google and Verizon have both previously denied they were in talks. In this announcement comes after the FCC abandoned its efforts on gathering major providers of broadband, wireless and content to discuss similar net neutrality guidelines. It was only a few months ago that a federal appeals court ruled the FCC do not have the authority to make Internet service providers follow such regulations.

My Take: The Internet is going to be a controversial subject for a long time to come. It is utilized by so many that it will be difficult to put any kind of regulation on it. You have businesses and individuals alike in so many countries that I can’t see how it can be regulated. In fact, you have people who get frustrated because they need their Blackberry repair and can’t get on the Internet and you want to add regulations on how they get on the Internet or using it. All you are doing is adding more frustration to their busy lives.

The Internet itself is a business without an owner. And everybody who was connected to it utilizes it in one way or another. A computer service company uses it to help clients were having computer problems. They provide a service of computer support among their many services and you start regulating net, you start interfering with their business.

Even PSP repair services can be interfered with because PSP’s are now able to get on the Internet. People would have to resort to the old-fashioned yellow pages to find someone to repair their PSP. That is a very time-consuming process compared to the Internet. Then you have the services that provide colocation. A company in New York who has colocation is going to have difficulty getting to their data if the Internet is regulated. The same would go for a business that had a Chicago colocation; they would have the same difficulty if they had colocation.

The only Internet regulation I could see that will be helpful to anyone is the one on pornography. If pornography had its own “.XXX”, I believe it would be much easier to catch pedophiles and rapists through the Internet. It would also help parents to regulate what their children see or find on the Internet.

Android phone owners just got Google’s newest feature, the new “Voice Actions” that was revealed on August 12. Now you can let your inner Inspector Gadget free because you can activate more than just Google searches by voice.

Just by speaking into their phones, Android owners will be able to send text messages and e-mail, call contacts, browse the Web and complete other basic tasks.

“Our mobile phones have become modern-day Swiss Army knives. An Android phone is a handheld computer, a music player, a notepad, an alarm clock, a GPS navigation unit and more, all rolled into one sleek device that fits in your pocket. Today’s phones do so many things for us that sometimes we don’t even think about how we do them,” said Google in a blog post today. “Even though our phones do all these new things, the most natural way of interacting with a phone remains what it always has been: speaking. And to that end, we’re pleased to introduce Voice Actions for Android.”

To use the feature, you tap the microphone button on the Google search box on the home screen, or press down the search button on the phone, to activate a “Speak Now” screen. Then you just speak your command.

Voice Actions Runs on Operating System Pre-Installed on New Droid 2

If you’re on your way to meet a friend but you’re behind schedule, all you have to do is say, “Send text to Ned: ‘I’m running 10 minutes late.’”

Or, if an out-of-town family member doesn’t know where to go, you could say, “Send e-mail to Kate directions to Central Park” — and voila! it’s done.

You can also send yourself reminder notes, set alarms, call up different websites and select music – all with the power of your voice.

Voice Actions only runs on the latest Android operating system (Android 2.2 or Froyo), which is pre-installed on the new Droid 2 smartphone, which Motorola and Verizon released today.

As long as they have the Android 2.2 operating system, users with older phones (like the HTC Evo, the Nexus One or the first Droid) can turn their phones into “go-go-gadgets” by downloading a few application updates from Google’s application market.

According to Google, they’ll need to download Voice Search (which includes Voice Actions), Google’s Search widget and Clock app, and music applications (for example, Pandora, Last.fm, Rdio and mSpot).

“Chrome to Phone” feature was also released August 12 and it allows Android users the ability to send links, maps any other information from their desktops and/or laptops to their phones. They must be using the Chrome browser because the new extension adds a button to the Chrome browser that gives them the stability. Once they click that button, they have the ability to send to any android phone running the android 2.2 operating system the link of whatever they’re looking at on the computer screen.

My Take: Okay, before you know it you will be able to hold your complete computer system in your hand because it will then be your phone as well. I can just see it, you go to the doctor and you have a fever, sore throat, strong wont plantar or some other symptom common with a viral infection and he pulls out his phone after drawing blood and running a test inputs information into the phone. Few minutes later his phone buzzes with the information on your results. He just did used antibody tester over the phone to tell you that you have mono.

Then, another few minutes pass and his phone buzzes with information on what drugs could best help you from the top pharmaceutical companies. And you thought the rapid test kits he had in the office or fast. Can you imagine what would happen if you went to South Riding dentist? I don’t think they’d be able to pull your teeth with a cell phone, no matter how advance to get. But, if you need cosmetic dental surgery, you could contact the South Riding VA cosmetic dentist in no time.

I know I am joking around about the advances in computers, but do you know when the 1st computer was made? Well, it was called the “Model K” and was built in 1937. That was only 73 years ago! When they made the more advanced “computers” they took up whole rooms and used the electricity that now runs over 700 desktop computers. Where will the computer be in another 73 years?

Has Our Imagined Science Fiction Future Disappeared?

Remember back in the 50s when people started dreaming about what the 21st century would bring with those fantastic flying computerized cars and the moving sidewalks. What about all those resorts that were going to be built under the sea? Were you one of the lucky ones in 1964 to get to see the “Futurama” at the New York world’s fair? If you were, you got to see a miniaturized replica of what a 21st century American city would look like.

Forty years later, we are still waiting for those congestion-free highways — along with the jet pack, the paperless office and all those “Star Trek”-like gadgets that were supposed to make 21st-century life so easy.

Daniel Wilson has been waiting as well. He has looked at the future we imagined for ourselves in pulp comic books, old science magazines and cheesy sci-fi movies from the 1950s, and came up with one question.

Why isn’t the future what it used to be?

“I feel entitled to have all this technology that’s been promised at a certain time,” says Wilson, author of “Where’s My Jetpack?” “I look up and say, ‘Where’s all this stuff?’ ”

Some of that futuristic stuff, it turns out, is already here. Visionaries actually invented objects like flying cars, but they could never work out the real world applications, Wilson says. Other inventions had the same problem. Ordinary people did not want to have anything to do with them.

These futuristic follies include everything from “Smell-O-Vision,” an invention that helped moviegoers smell as well as see movies; Sanyo’s “ultrasonic ultra-squeaky clean human washing machine” (it was dubbed the “human washing machine,” but would not fit in an ordinary bathroom) and, of course, the jet pack.

“Scientists are OK at predicting what technology is going to happen in the future,” Wilson says. “They’re really bad at predicting how it’s going to affect us.”

What happened to my jet pack?

The jet pack is a perfect example of predicting the future, Wilson says. He says the jet pack first appeared in 1928 in an Amazing Stories comic book, which featured the hero Buck Rogers zooming though the sky in a jet pack.

The jet pack was actually developed by 1961, Wilson says. An inventor mounted a rocket onto a backpack and called it a rocket belt. A variation of the rocket belt even appeared in the 1965 James Bond movie, “Thunderball.” Today, the jet pack continues to grab inventors’ imaginations.

A daredevil wearing a jet pack flew across a 1,500-foot-wide canyon in Colorado in November. A Swiss pilot, dubbed “Fusion Man,” flew across the English Channel last year using a single jet-propelled wing. And a New Zealand inventor recently invented a jet pack, which weighs about 250 pounds, that reportedly can run for 30 minutes.

The jet pack, though, has never really taken off, Wilson says. The problem is its practical application. While a rocket belt could propel a screaming human to 60 mph in seconds, its fuel lasted for only about half a minute, “which led to more screaming,” Wilson says.

The military could not find a useful application for it either. A soldier with a jet pack might look cool, but he is an easy target. Nor could a jet pack be of use to ordinary people who wanted to avoid rush-hour traffic, Wilson says. Jet-packing hordes could transform the skies into an aerial demolition derby, with air rage and drunk drivers turned into wobbly human torpedoes."Wakamaru" is a 3-foot-tall robot that can serve human beings.

Yet other bold visions of the future have come true. Remember Rosey the Robot? That was the name of the robotic maid that waited on the Jetsons, the popular cartoon family from the future. Rosey has become “Wakamaru.” That’s the name of a 3-foot-tall robot with a goofy grin that the Mitsubishi conglomerate in Japan invented to assist elderly people at home by doing everything from reminding them to take their medicine to looking out for burglars. Wakamaru can recognize faces and up to 10,000 words, Wilson says. “Beam me Up Scotty,” is a tagline from another television show, “Star Trek”. But teleportation has been invented, Wilson says. He says a group of international scientists successfully transported a photon — a bundle of electromagnetic energy — from one side of a room to another in 1993. Physicists routinely conduct teleportation experiments today, Wilson says.

“Teleporting anything, even elementary particles, is mind-blowing,” Wilson says. “Why is it that most people don’t know it exists? It has not been put into practice yet. In real life, it’s always about, ‘What can you do for me?’”

A darker view of technology’s future.

People’s fascination with technology’s imprint on the future did not start, however, in the mid-20th century with shows like “The Jetsons” or “Star Trek.” Joseph Corn, co-author of “Yesterday’s Tomorrows: Past Visions of the American Future,” found an inflated optimism about technology’s impact on the future as far back as the 19th century, when writers like Jules Verne (”Twenty Thousand Leagues Under the Sea”) were creating wondrous versions of the future. Even then, people had a misplaced faith in the power of inventions to make life easier, Corn says.

For example, the typical 19th-century American city was crowded and smelly. The problem was horses. They created traffic jams, filled the streets with their droppings and, when they died, their carcasses. But around the turn of the 20th century, Americans were predicting that another miraculous invention would deliver them from the burden of the horse and hurried urban life — the automobile, Corn says.

There were a lot of predictions associated with early automobiles,” Corn says. “They would help eliminate congestion in the city and the messy, unsanitary streets of the city.” Corn says Americans’ faith in the power of technology to reshape the future is due in part to their history. Americans have never accepted a radical political transformation that would change their future. They prefer technology, not radical politics, to propel social change.

“Technology has been seen by many Americans as a way to get a better tomorrow without having to deal with revolutionary change,” Corn says. Today, however, a more sober view of technology has sneaked into the nation’s popular culture. In dystopian sci-fi films like “Blade Runner,” and “Terminator,” technology creates more problems than it solves.

“Battlestar Galactica,” the recent television series, is a prime example. It depicts a world where human beings have created amazing technology that has brought them to the precipice of extinction. There is no Buck Rogers zooming blissfully through the sky. The show follows the journey of a group of humans who created a race of robots called Cylons a. The Cylons rebel, virtually wipe out humanity with nuclear weapons, and pursue the survivors through space.

Mark Verheiden, a Battlestar writer, says the show’s writers pay attention to current events when plotting their story lines. The contemporary world is filled with the unintended consequences of technology, he says. “There are so many things you can’t anticipate when you create a new technology,” he says. “Who would have predicted that the Internet would be taking down shopping malls and wiping out newspapers?”

In Battlestar’s finale, human beings abandon their faith in technology’s ability to improve the future. They destroy their fancy machines and start again as simple hunter-gatherers. “At some point, you can’t expect a miracle to come in the form of technology to save us,” Verheiden says. “At some point, the miracle has to come from a change in attitude and a new outlook.” That does not mean, however, that Verheiden is not a fan of imagining future technology. He says he grew up watching “Star Trek” and immersing himself in Futurama-like exhibits.

The elevated cities and the “Star Trek” voyages of yesteryear may now seem corny, but at least they show humanity has a future, he says.

” ‘Star Trek’ was saying [that] a thousand years from now, people [will] figure out how to get along,” Verheiden says. “In some ways, sci-fi says that the future is still optimistic, because no matter how bleak things are, it suggests that we’re still here.”

My Take: There is a saying in the sci-fi world, “Yesterday’s science fiction is today’s science.” There is more truth in poetry in phrase. “Star Trek” is a perfect example of that phrase. Many things that were imagined on the show are now a reality. Some of those things are from the sick bay on the Enterprise like that fabulous medical bed that told Dr. McCoy what was wrong with his patients. There is now a bed very similar to that in existence called the “Life Bed”.

Much of the science fiction that is now science is in existence; however, our society is not ready for any of it. Science moves faster than society does. This article mentions the flying car and the jet pack. Our society is nowhere near ready for them, maybe in another hundred years. When we get our heads screwed on right and have learned not to drink and drive. On the other hand, maybe they could use some of that technology from science fiction to determine if a person’s blood alcohol is too high to drive by just touching the car door.

The people of yesteryear who were waiting for the paperless office can see it already. With computer technology the way it is right now, a business could conceivably have the paperless office. However, people like to be able to hold something in their hands and read it, we are almost there with iPods, cell phones, and other gadgets that allow us to hold in our hand what would normally be printed on paper.
